• 1.0 Your acceptance

This is an agreement between isLife, the owner and operator of isLife, the isLife software, and you as user of the service.

BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE TO THESE TERMS OF APP, AND THE isLife’s PRIVACY POLICY, INCORPORATED HEREIN BY REFERENCE. If you choose to not agree with any of these terms, you may not use the app.

• 1.1 Data Collection and Storage

isLife has the ability to save some kind of materials, in different locations, in the following way:

• • Photos: the photos included are copies from the library, saved in the private folder, and only a reference to each photo will be present in case that the app is deleted.

  • Videos: only a reference and a thumbnail for each video is saved, being recoverable

  • Photos and Videos will be recoverable, whenever could be present into the library.

  • Audio: Audios are saved in the private directory, an also in the private zone in iCloud (when iCloud is used for backup). No access is available for nobody if not the user.

  • Texts, comments in materials, are saved in the private directory and iCloud (when used).

  • All of data will be erased in case of app deletion. Only when restoring the app, the user can restore a backup from iCloud, if this state was accepted previously.

  • The data is minimally saved. In the case of video, isLife offers the possibility to save it simultaneously into the library and App’s folder, but not force to it. Because of you can save your creations in your library, looking for not duplicate with no sense the materials, the videos saved locally into the app are not shared or synchronised. All of the movies you can create are build on the fly, so don’t take up space on the device.

Specially, isLife NEVER will ask, collect, keep or store any billing information. No one way is allowed to do this. We do not use your mobile phone number or other Personally Identifiable Information to send commercial or marketing messages in any way.

• 1.2 Permissions needed

(A) What permissions isLife needs and makes use of.

isLife needs permissions in order to make use of Photos, Videos, Audio, Microphone, Speech Recognition, Camera, Multimedia and Apple Music, and Mobile Use., in the following way:

• • Photos and Videos choose form the library, albums, or take it directly from the camera.

  • Audio created and saved directly, for include into materials.

  • Texts created or dictated.

  • Music to be used as background track, if the creations are shared privately (music form your library will show always the copyright, only for private use, never shareable on social nets.

  • isLife will offer but never force to you the use of iCloud, in order to obtain two services: the backup of your data, or the synchronisation between multiple devices you could have.

(B) What permissions isLife does not needs or makes use of.

isLife does not makes use any other service included in the previos subchapter: when the user share a content under a social net, or sen a mail including the content, isLife is using the default way, never collecting neither location or contacts, nor other kind of information.

• 1.3 Account Sign-In

isLife needs your sign in into your account, at first time, or after abandon partially the app and come back, with the only purpose to ensure that: you are the only owner who access, who can create and/or publish any material, when creating or accessing to some of the integrated social net or app account (by now, Facebook, Twitter, WhatsApp, Instagram, Telegram, or your mail).

No access to your material or publishing on your behalf will be allowed, if you does not sign in into your account previously.

isLife does not collects your passwords or personal data when publishing or accessing to any social net, and never share or send no one piece of material.

• 1.4 About prohibited or illegal materials.

IsLife will not be responsible for any video containing materials that could include or become:

• Defamatory, discriminatory, intimidatory, harmful, or offensive against religion, sexual gender, ethnics or individuals.

• Showing any kind of violence, abuse, torture, obtained with purpose, against animals, persons, places or natural values.

• Any kind of pornographic material.

• Any material offending specially kids.

• Unlawful, obscene, libellous, threatening, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offence, give rise to civil liability, violate any law, or is otherwise inappropriate.

• falsehoods or misrepresentations that could damage any individual;

• 1.5 Use of Music.

IsLife offers the user the ability to include a background music in you videos. Special advise is made about the music in your iTunes or Apple Music Library.

• The only way you can share a video created by you, with copyrighted music is into your devices, or by mail with your friends.

• The app will never permit share or publish any material containing copyrighted music, to any social net or app.

• isLife offers and increase with new songs a list of free use songs to share videos publicly.

• Each song is accompanied by its copyright image and phrase, following the Common Creative License.

• All of the songs that isLife will include for each new version, will be completely free for use and share on your videos.

• To file a copyright infringement notification, please send a written communication that includes substantially the following (see Section 512(c)(3) of the Digital Millennium Copyright Act): (i) A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed; (ii) Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works; (í) Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material, including the mobile phone number of the isLife user allegedly infringing the copyrighted work; (iv) Information reasonably sufficient to permit the service provider to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted; (v) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law;

• A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorised to act on behalf of the owner of an exclusive right that is allegedly infringed. Such takedown notices may be emailed to support at ateliervitali@gmail.com. isLife reserves the right to remove content and Status Submissions without prior notice. isLife may also terminate a user's access to the Service, if they are determined to be a repeat infringer, or for any or no reason, including being annoying. A repeat infringer is a User who has been notified of infringing activity more than once and/or has had a Status Submission removed from the Service more than twice. An annoying person is anyone who is determined to be annoying by authorised isLife employees. isLife also reserves the right to decide whether content or a Status Submission is appropriate and complies with these Terms of Service for violations other than copyright infringement and violations of intellectual property law, such as, but not limited to excessive length or limited interest. isLife may remove such Status Submissions and/or terminate a User's access for uploading such material in violation of these Terms of Service at any time, without prior notice and at its sole discretion.

• 1.6 Publishing.

isLife, does not share any data from any user. The only way to share your personal information is the share action that you have decided for each social net where you have a profile, and where you publish a video. No relationship between isLife and other social net is present, active, in any way.

If you decide make visible your property about your videos, isLife offers you the possibility that you can show a picture and a name at he end of the video, but not necessarily. In this case, you will publish your copyright with your video, making visible this information.

. Neither your name, mobile number, email or personal data will be published, known, acquired, hosted on the app. The only personal data available for other users is the video material already shared publicly in other services such Facebook, Twitter, Instagram or WhatsApp.

• 1.7 Intellectual Property Rights.

The design of the isLife app along with isLife created text, code, graphics, interactive features, and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to isLife, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. The Service is provided to you AS IS for your information and personal use only. isLife reserves all rights not expressly granted in and to the Service. You agree to not engage in the use, copying, or distribution of any of the Service other than expressly permitted herein, including any use, copying.

All of the materials you create with isLife, if not including materials for those you are not the owner, are of your property, and you can include a copyright for it. Materials that you can create, join, compose, save and share are, always form your property: Photos, Videos, Audios, Texts, Songs (privately when you are using your private songs, or publicly when you are using free songs), and mixes from all of them.

• 1.8 Warranty Disclaimer.

YOU AGREE THAT YOUR USE OF THE isLife SERVICE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, isLife, AN ALL EMPLOYEES RELATED, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICE AND YOUR USE THEREOF.

isLife MAKES NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THIS SERVICE’S CONTENT AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF OUR APP.

isLife MAKES NO WARRANTIES OF PERFORMING FOR THE APP IF THE USERS’S DEVICE SECURITY SYSTEM HAS BEEN BROKEN (JAILBREAK), IN ORDER TO ENSURE THE SAFETY FOR THE USER AND OTHER USERS.

• 1.9 Limitation of Liability

YOU SPECIFICALLY ACKNOWLEDGE THAT isLife SHALL NOT BE LIABLE FOR USER SUBMISSIONS OR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY AND THAT THE RISK OF HARM OR DAMAGE FROM THE FOREGOING RESTS ENTIRELY WITH YOU.

isLife makes no representations that the isLife app is appropriate or available for use in other locations. Those who access or use the isLife app from other jurisdictions do so at their own volition and are responsible for compliance with local law.

• 1.10 Indemnity

You agree to defend, indemnify and hold harmless isLife, its parent corporation, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from:

(1) your use of and access to the isLife app;

(2) your violation of any term of these Terms of Service;

(3) your violation of any third party right, including without limitation any copyright, property, or privacy right;

(4) any claim that one of your Status Submissions caused damage to a third party. This defense and indemnification obligation will survive these Terms of Service and your use of the isLife app.

• 1.11 Ability to Accept Terms of Service

You affirm that you are either more than 16 years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Service, and to abide by and comply with these Terms of Service. In any case, you affirm that you are at least 16 years old as the isLife Service is not intended for children under 16. If you are under 16 years of age, you are not permitted to use the isLife App. You further represent and warrant that you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a” terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. isLife is the developer of the App, with an address at Carrobide 9-7, 31610, Villava, SP 691966289, info at ateliervitali@gmail.com.

• 1.12 Assignment

These Terms of Service, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by isLife without restriction.

• 1.13 General

You agree that:

(1) the isLife App shall be deemed solely based in the EE.UU;

(2) that you agree to subject to the jurisdiction of Massachusetts in the event of any legal dispute. These Terms of Service shall be governed by the internal substantive laws of the State of Massachusetts, without respect to its conflict of laws principles. Any claim or dispute between you and isLife that arises in whole or in part from the isLife Service shall be decided exclusively by a court of competent jurisdiction located in Massachusetts. These Terms of Service, together with any other legal notices published by isLife, including, but not limited to an end user license agreement, shall constitute the entire agreement between you and isLife concerning the isLife Service. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. No waiver of any term of this these Terms of Service shall be deemed a further or continuing waiver of such term or any other term, and isLife's failure to assert any right or provision under these Terms of Service shall not constitute a waiver of such right or provision. isLife reserves the right to amend or modify these Terms of Service at any time, and it is your responsibility to review these Terms of Service for any changes. If you do not agree to the revised Terms, your only recourse is to discontinue the use of the isLife Service. Your continued use of the isLife Service following any amendment of these Terms of Service will signify your assent to and acceptance of its revised terms. YOU AND isLife AGREE THAT ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE isLife SERVICE MUST COMMENCE WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY BARRED.

• 1.14 Privacy

isLife recognizes that its customers want to know what's up with privacy. isLife provides this Privacy Policy to help you make an informed decision about whether to use or continue using the isLife App. If you do not agree to our practices, please do not use the isLife App. This Privacy Policy is incorporated into and is subject to the isLife Terms of Service. Your use of the isLife App remains subject to the terms of this Privacy Policy and our Terms of Service.

• 1.15 Changes/Updates to Privacy

This Privacy Policy may be revised periodically and this will be reflected by the effective date below. Please revisit this page to stay aware of any changes. Your continued use of the isLife Site and isLife Service constitutes your agreement to this Privacy Policy and any amendments.
